Warranty

This warranty is issued by Evoke Electrical Services Pty Ltd to the original purchaser of the product(s) listed below.

Warranty Period

The product(s) are warranted against defects in materials and workmanship for a period of two years from the date of purchase. The servicing is warranted for a period of five years from the date of purchase.

What is Covered

This warranty covers the repair or replacement of any defective parts in the product(s). It also covers the cost of labour to repair or replace the defective parts.
Only products supplied by Evoke Electrical Services Pty Ltd. will be covered.
Only installations conducted by Evoke Electrical Services Pty Ltd. will be covered.
The purchaser must produce the invoice provided on the completion of the original works to be able to claim under warranty.
Only works undertaken outlined in the invoice will be eligible for warranty.
To be eligible to claim the service warranty, it must be identified by Evoke Electrical Services Pty Ltd. the fault was caused by the installation of Evoke Electrical Services Pty Ltd.
If another electrical company/individual not employed by Evoke Electrical Services Pty Ltd. has undertaken any work on the services identified in the Evoke Electrical Services Pty Ltd. supplied invoice since Evoke Electrical Services Pty Ltd. completed the work, the warranty will be void.

What is Not Covered

This warranty does not cover damage caused by:

  • Accidental damage

  • Misuse

  • Service or products not supplied by Evoke Electrical Services Pty Ltd.

Products supplied by Evoke Electrical Services Pty Ltd. will be subject to the warranty of the supplier and Evoke Electrical Services Pty Ltd. will not be responsible for the conditions of the third party warranty.
In the event that the suppliers warranty is less than two years and the equipment fails due to product defect and can be identified by Evoke Electrical Services Pty Ltd. that it was a product defect, Evoke Electrical Services Pty Ltd. will replace or repair the defective product under warranty.
An invoice issued to the purchaser must be presented. Any products/services not listed on the invoice will not be covered by warranty.

Warranty only applies to paid invoices or invoices that are not past their payment terms.

How to Make a Warranty Claim

To make a warranty claim, please contact Evoke Electrical Services Pty Ltd. at 0416718411 or Contact@evokeelectric.com.au.
You will need to provide the following information:

  • Your name

  • Your contact information

  • The date of purchase

  • The serial number of the product(s) (If applicable)

  • A description of the problem


Limitations of Liability

The liability of Evoke Electrical Services Pty Ltd. under this warranty is limited to the repair or replacement of the defective parts. Evoke Electrical Services Pty Ltd. is not liable for any other damages, including consequential or incidental damages.

Dispute Resolution

Any disputes arising out of this warranty will be resolved through mediation or arbitration. If mediation is unsuccessful, the parties will agree to arbitration in accordance with the rules of the Australian Commercial Disputes Centre.

Entire Agreement

This warranty constitutes the entire agreement between the parties with respect to the product(s) and supersedes all prior or contemporaneous communications, representations, or agreements, whether oral or written.

Modification

This warranty may not be modified or amended except in writing signed by both parties.

Governing Law

This warranty will be governed by and construed in accordance with the laws of the State of Victoria.

Notices

All notices and other communications under this warranty will be in writing and will be deemed to have been duly given when delivered in person, upon the first business day following deposit in mail, postage prepaid, certified or registered, return receipt requested.

Waiver

No waiver of any provision of this warranty will be effective unless in writing and signed by both parties. The failure of either party to enforce any provision of this warranty will not be deemed a waiver of such provision or of any other provision of this warranty.

SEVERABILITY

If any provision of this warranty is held to be invalid or unenforceable, such provision will be struck from this warranty and the remaining provisions will remain in full force and effect.

Acceptance

By accepting delivery of the product(s), the Purchaser agrees to the terms and conditions of this warranty.

Additional Information

This warranty is in addition to the consumer guarantees that are provided under the Australian Consumer Law. The consumer guarantees cannot be excluded or limited by this warranty.
